A bench of Chief Justice D Y Chandrachud and Justices J B Pardiwala and Manoj Misra set aside the National Company Law Appellate Tribunal (NCLAT) ruling that upheld the transfer of the airline’s ownership to JalanKalrock Consortium (JKC). The bench stated that the liquidation was in the interest of creditors, workers, and other stakeholders of Jet Airways. T he court noted JKC’s failure to infuse the promised funds of `350 crore to revive the cash-strapped airline. The SC said no progress was seen the resolution plan even after five years, leaving it with no choice but to send Jet Airways into liquidation. “Keeping in mind the fact that almost five years have elapsed since the Resolution Plan was duly approved by the NCLAT and there being no progress worth the name, we are left with no other option but to invoke our jurisdiction under Article 142 of the Constitution and direct that the corporate debtor be taken in liquidation,” it said in the order. The SC held the NCLAT’s directive for the SRA to adjust `150 crore towards the first tranche payment was in disregard of the Supreme Court’s earlier order and the terms of the resolution plan. The bench also ordered forfeiture of `200 crore invested by the consortium and authorised the lenders to invoke the `150 crore bank guarantee to recover some of their dues. The NCLAT had in March upheld the resolution plan of Jet Airways and approved the transfer of its ownership to JKC. SBI, Punjab National Bank, and JC Flowers Asset Reconstruction Pvt Ltd challenged the NCLAT verdict. Jet Airways stopped flying in April 2019. The National Company Law Tribunal in June 2021 gave approval to the Kalrock Capital and Murari Lal Jalan consortium’s bid for Jet Airways, eight months after the lenders had given a goahead to its resolution plan. The consortium was supposed to infuse `1,375 crore in Jet Airways over 2-3 years. In the first tranche, it was to infuse `350 crore and `250 crore in the second tranche. The remaining `775 crore was to be infused from the second year. Speaking with this paper, UGC Chairman Prof M Jagadesh Kumar said, “The introduction of Ayurveda Biology as a paper in UGCNET will encourage aspiring students to the Sanskrit texts of Āyurveda to integrate the deep knowledge contained in these texts to create a holistic and sustainable model for study and research in contemporary biological sciences.” After they complete their PhD programme in Ayurveda Biology they will have the op, portunity to join Universities to research and train future generations of students, he said. Prof Kumar added that with people becoming more aware of the benefits of natural and holistic healthcare, Ayurveda has become popular as an alternative to allopathic medicine, contributing to the rapid expansion of this sector. “Ayurveda is increasingly being integrated with modern healthcare systems.
